TERMS AND CONDITIONS
These general terms and conditions govern the relationship between the Art Bully Training Center, hereinafter referred to as “the ABTC”, and the users of the websites and services available on the website, hereinafter referred to as the “USERS”.
All the correspondence between the ABTC and the USERS should be done in the electronic form, by email or discord.

DEFINITIONS
The Website – artbully-school.com
User – any individual, or a representative of a business entity, who purchases or uses our services.
Training / Online course – digital or online face-to-face training, announced on the ABTC website with content and schedule attached.
Services provided – ABTC provides through the www.artbully-school.com website the opportunity for USERS to apply and participate in training courses chosen by them after paying the course/courses fee.
The ABTC is obliged to ensure the USER’s access to the services provided.
Work – Any and all 2D media including but not limited to: sketches, thumbnails, drawings, mood paintings; as well as any 3D media, including but not limited to: 3D models, Textures, and renders, generated during the duration of the 3D online course by the USER.
This document contains information about the activities of the ABTC and the general conditions for using the services provided by the ABTC, regulating the relations between the ABTC and each of its USERS.
Confirmation of the terms and conditions is a necessary and mandatory condition for concluding the agreement between the USER and the ABTC.
ABTC reserves the full right, at its discretion, to change, modify, alter in any way they see fit, sections of the Terms and Conditions, at any time. USERS’s access and the use of the ONLINE COURSE, will be subject to the most current version of the Terms and Conditions, posted on the ABTC Site at the time of such use.
Please regularly check the “Terms and Conditions” link on the home page of www.artbully-school.com to view the current terms. USERS will be considered notified to any changes by updating the “Latest Updates” date of these Terms and Conditions, and you waive any right to receive specific notice of each such change.
As long as the USER complies with these Terms and Conditions, the ABTC grants the USER a personal, non-exclusive, non-transferable, right to enter and use the online course.
PROPERTY
This website is owned by the Art Bully Training Center, with headquarters and main place of activity: Takovska 23, Belgrade 11000, Serbia.
The intellectual property rights over all materials and resources, located on the website of the ABTC and its databases, and are protected under the Intellectual Property Registry in Belgrade, belong to the ABTC, and may not be used in violation of applicable law.
Unless explicitly provided in these Terms and Conditions, no part of the online course may be copied, republished, reproduced, uploaded, posted, publicly displayed, encoded, translated, transmitted, or distributed in any way (including “mirroring”) to any other computer, workstation, server, website or any another medium for publication, distribution or for any commercial enterprise, without ABTC’s prior written permission.
In case of the infringement of any of the above-mentioned actions, beyond the permissible, as well as any other violation of intellectual property rights over the resources of the ABTC, the ABTC has the right to claim compensation for direct and indirect damages.
Except when specifically agreed, the USER may not reproduce, modify, delete, publish, distribute and otherwise disseminate the informational resources published on the website of the ABTC.
ABTC will maintain the exclusive ownership of all 2D media including but not limited to: sketches, thumbnails, drawings, mood paintings; as well as any 3D media, including but not limited to: 3D models, Textures, and renders, generated during the duration of the 3D online course by the USER.
ABTC reserves the right to use, publicly display, publicly perform, copy, edit, modify in any way, reformat, reproduce and distribute artwork, renders, 3D models, textures, sell and auction any other material that the USER worked on during the online course, for the purpose of the ABTC’s online course, with or without having USER’s name/credentials attached to renders or images, in any manner or form and for any purpose, or compensation towards the USER.
The ABTC has the right, but not the obligation, at its discretion to delete information resources and materials published on its website.
ON-LINE TRAINING PROGRAM
The USER is obliged to follow the schedule of their Training for which they acquired access to, as agreed with the online tutor, as well as to monitor all messages related to the Training, and to comply with them. The USER must honor the scheduled meetings with the Online tutor. In the case that the USER can’t meet the agreed time, the ABTC will do their best to re-schedule the session. However, ABTC does not guarantee the availability for the re-scheduled sessions, and therefore, the USER might lose the session in question.
The ABTC has the right to change the Training schedule, notifying the User in a timely manner.
USERS need to be 18 years of age or older in order to independently purchase and use the ABTC Online Course. USERS under the age of 13 are not permitted to use any of the services provided by the ABTC. USERS from ages 13 to 18 may only use the services, provided by the ABTC, with the written permission from the parent or a legal guardian.
The Terms and Conditions are considered active and effective and should be legally obliged, from the moment of confirmation of the order by the ABTC.
In the case of inability to perform the services, the ABTC reserves the right to refuse the purchase order.
After placing an order, the USER will receive an e-mail confirmation that their order has been accepted, and they will be granted the access to the course materials.
The ABTC reserves the right to request from the USER certain documents that might become mandatory in the future, for participation in the Trainings. In case such documents are not presented, the ABTC may refuse the access to the Trainings or suspend such access.
ABTC does not provide USERS with any software licenses. The users are responsible for their own license acquisition. The list of specific software licenses needed for each individual Online Course will be specified on the course page, under Software needed section.
ABTC will state the minimum hardware specifications needed for each individual Online Course, and it will be specified on the course page, under the Minimum Hardware needed section.
We encourage USERS not to partake in any of ABTC courses if their computer does not meet the minimum hardware specifications. ABTC will not be held accountable if the USER cannot follow the Training due to hardware incompetence.
The ABTC has the right to refuse to give access for the Online Course, or terminate the existing access with a USER that are flagged for one or more, but not exclusive to the following:
– USER that is not-compliant with the Terms and Conditions;
– USER that is arrogant or rude towards the Online mentor, Online Assistant, or any other representatives of the ABTC, other USER, or any other related person or entity related to ABTC;
– USER that systematically abuses the ABPTC in any way shape or form;
– User that provides access through their username and password to third parties who are not the USERS of the ABTC services;
– USER that is not following a good rule of conduct on the ABTC Discord groups or any other social media platform or anywhere else related to ABTC;
PAYMENTS AND PRICES
The prices of the offered services are indicated on the website of the ABTC at the time of placing an order.
The ABTC is using a third-party payment method “Stripe”.
The ABTC is not responsible if a payment method involving a third-party payment service provider is not available or otherwise does not function due to reasons that cannot be attributed to the fault of the ABTC.
CERTIFICATION
Upon the successful completion of the online course the ABTC will issue the Certificate for Completion of the 3D Game Art Course.
THE WITHDRAWAL
The USER has the right to withdraw from the online course without stating a reason, without paying compensation or penalty within 10 days or 3 online lectures from the date of the purchase.
In order to exercise their right under this clause, the USER must unambiguously inform the ABTC of their decision to withdraw from the on-line course. This should be done by individualizing the on-line course they wish to opt out from, by providing all of the details of the order, including but not only: content and value of the order, data of the person who made the order, etc. before the expiration of the 10-day period, or 3 online lectures. The message for withdrawal should be sent through the official correspondence channels specified in these Terms and Conditions.
ABTC will refund the full amount of the online course, if the USER obliges the above mentioned 10 days, 3 lectures rule for cancellation.
In the case that the ABTC incurs additional third-party costs for the cancellation of the online course, the ABTC has the right to withhold the amount for the costs incurred by the third party.
With the purchase of the online course, the product is considered to be available for use by the USER, therefore the implementation of the Terms and Conditions are considered active, which the USER explicitly confirms by accepting these Terms and Conditions.
The refund will be issued no later than 14 days from the day of cancellation.
RESTRICTIONS AND TERMINATION OF USE
ABTC reserves the right to block, restrict, disable, suspend or terminate USER’s access to all or part of the on-line course, at any time in ABTC’s sole discretion, without prior notice or liability to the USER.
ABTC reserves the right to modify, suspend or terminate operation of, or access to, the on-line course, or any portion of the on-line course, for any reason, at any time, without notice.
FINAL PROVISIONS
The invalidity of individual clauses of these Terms and Conditions does not lead to the invalidity of the entire Terms and Conditions. If any of the provisions of these Terms and Conditions is treated as an unfair clause, it is not considered binding on the USER, but in its entirety the Terms and Conditions continue to apply to the parties under the other conditions, where it can be implemented without unfair terms.
COPYRIGHT INFRINGEMENTS
If the USER believes that any material available on or through the on-line course infringes upon any copyright, they or anyone else owns or controls, please immediately notify ABTC using the contact information provided below.
USER REPRESENTATIONS
USER is bound NOT to:
If the USER provides any information that is untrue, inaccurate, not current, or incomplete, ABTC has the right to suspend or terminate USERS, access and the account, and refuse any future use of the ABTC services.
The USER must refrain from:
– Creating a false identity for the purpose of misleading others, spreading misinformation, or in any other way defaming the ABTC name, materials, online courses, other services, general conduct and customer service.
– Engaging in any junk e-mail, chain letters, surveys, contests, pyramid schemes, spamming, or any other duplicative and/or unsolicited messages.
USERS can provide ABTC with suggestions or feedback. All of the submitted suggestions or feedback shall be deemed to be non-confidential. ABTC shall be free to use such information in any way it sees fit.
